The Ministry of Corporate Affairs (“MCA”) has now notified the much awaited National Company Law Tribunal Rules (“NCLT”), 2016 and the National Company Law Appellate Tribunal (“NCLAT”) Rules, 2016 on 21 July 2016.
While the NCLT Rules outline the detailed procedure for institution of proceedings and filing petitions or applications and the manner of instituting such proceedings, filing petitions or applications under certain sections of the Companies Act, 2013, the NCLAT Rules prescribe the procedure for institution of appeals.
This update is furtherance to the update shared on 2nd June 2016 about Constitution of NCLT and NCLAT
The rules shall come into force on the date of its publication in the Official Gazette.
